Driver's License Suspension

If you are arrested for DUI, your driver's license will automatically be suspended. However, it is possible to obtain a restrictive license that allows you to drive from home to work or school and back. It may even be possible for you to keep your license altogether. These may only be possible if you challenge the suspension at an administrative hearing at the Department of Motor Vehicles (DMV). Time is of the essence in these matters. You only have a few days after your arrest to request a driver's license hearing.

Accelerated Rehabilitative Disposition (ARD)

Pennsylvania offers an alternative type of consequence for first-time offenders of nonviolent crimes. This is called the accelerated rehabilitative disposition (ARD) and offers a way for individuals to avoid jail time, maintain their driver's licenses and have their records expunged after successful completion of the program requirements. As part of ARD, you may have to undergo alcohol education and treatment classes, attend meetings with your supervising official, be free of additional criminal charges, and pay court-ordered fines, along with any other specific requirements that the court orders.
