What Is Probate?

Formal probate is the process that is used to administer the estate of a person who died with or without a will. If the individual died with a will, probate may involve proving that the will is valid, paying applicable taxes and executing the deceased individual’s instructions.

You may be able to make the probate process simpler for your loved ones after you are gone by writing a will. Your will states who will inherit your assets and property, who will carry out your wishes as specified in your will and who you have designated to care for your minor children if both you and your spouse die. The parties involved in the probate process include:

  • Executor: The executor is in charge of carrying out the will’s instructions. This person may also be referred to as the personal representative.
  • Decedent: The decedent is the deceased individual whose estate is going through the probate process.
  • Administrator: If an individual dies without a will, an executor will be appointed by the court. This executor is known as the administrator.

If an individual dies with a trust, the probate process may be minimized. However, other estate administration steps, such as preparing and filing Pennsylvania inheritance tax returns and federal estate tax returns, are still necessary.

Distributing the Estate

As the executor, you are responsible for distributing the estate. Review the will carefully to ensure you distribute the decedent’s assets as they have requested. Before distributing property, you should ensure it was still owned by the decedent at the time of death and that each of the beneficiaries is still alive. You should also review whether the decedent stated how taxes, expenses and debts are to be paid.
